There is a very large spectrum of "letsplay" content. For example: What about speed runners who rarely speak but provide content in the form of just playing the game really efficiently? Is that transformative? |

Yeah the issue is there's no set rules on any of it, particularly what's transformative or not. Your case can be argued, like what happened with H3H3 and they won but it's down to who owns the license on whether or not your video is transformative enough or not and how the judge hears them out. So if they decide screw you, you basically have no defence unless you happen to be rich. They can easily argue that if your video is just gameplay and a facecam, it's still 90% footage from their property thus you made money off their property. It's all pretty s***ty really, they could make so much more money by taking advantage of let's players, which is easily proven whenever anyone does it. Guarantee PUBG wouldn't even be half as popular without all the streamers and such hyping it up. |

Well, firstly, it depends if they are monetizing it or not. If they are then like I said before it depends on the agreements stated in the game. And it also depends on the company. Some companies are actually completely fine with people monetizing from ad revenue as long they stay within certain content-appropriateness guidelines. For example Ubisoft and Microsoft Studios. In fact, when YouTube in 2013 had a change in their Content ID policy that caused many Let's Play and other video-game related material to be blocked, many developers and publishers issued statements and worked with YouTube to assure such videos were not meant to be blocked, helping those whose videos were affected, and encouraging users to continue. These companies included Blizzard, Ubisoft, Capcom, Paradox and Interactive. And, Valve are also okay if you monetize as stated in their video policy. |

If it's on YT, then either they've chosen to allow it (whether or not it breaks the copyright) or they're not aware of its existence. They may choose to allow it because they want the publicity (or want to avoid bad publicity), because they appreciate the fans or because it's not financially worth chasing up. In some cases a playthrough might have enough original content that if it was contested in court, the copyright holder wouldn't win. edit: Many times, videos may get taken down automatically, even though they are not breaking copyright, but it won't be contested by the YTer, just because it's a hassle.
